Flogging a Deceased Equine
March 24th, 2005 | by Craig |I know I keep harping on this, but you can pass all the laws you want, and the problems of underage drinking and DUI are still ones of culture, not legality.
Last I checked it was against the law to drink under 21, and/or drive under the influence; but it doesn’t seem to make any difference.
This is Montana, for cryin’ out loud. Look at these small towns in the middle of nowhere that are nothing but a bar and a post office. You don’t think that people are sipping coffee there until 2:00 a.m. and then walking home, do you?
In my younger days I took a wrong turn on a 70 mile stretch of dirt road that ended up turning into a two-track, and what should I find clear out there? A bar. With cars in the parking lot.
Oh well. At least the legislature is Doing Something About the Problem™.

I’m with you 100% on this issue. It’s already illegal. People who drive drunk aren’t weighing the pros and cons of how severe the penalty is, they are just drunk and irresponsible.
I’m also opposed to the open-container ban. Again, it is already illegal to drive drunk, and that is supposedly the purpose of the open-container ban. Our existing law is a sensible one that respects the individuals freedom by only outlawing behavior that has a negative effect on society — driving under the influence — rather than behavior that hurts no one.
It’s like our old ‘basic rule’ speed law — a truly sensible statute that worked. Did we spend our time back then watching the road, or our speedometers?
But I recognize the political incorrectness of my views on this issue and the inevitability of an open container ban. Still, I applaud those legislators who have resisted the nanny-culture of political correctness and voted against this unnecessary measure.
