In class today, the subject of U.S. Circuit Courts came up.

During the discussion, the prof briefly mentioned that there was a movement to create a 12th Circuit Court.

He explained that the reason this movement was afoot was because there is an argument that (and I quote), “The 9th Circuit is too quote, unquote ‘liberal.’” He waved his fingers to indicate the quotes around liberal.

Oddly enough, he didn’t use the finger quotes when he described the 4th circuit as conservative.

This could be a long semester.

    I would use the finger quotes to call the 9th “liberal.”

    I would not use finger quotes to call the 9th “slightly beyond the Twilight Zone.”

    And I’m glad the 9th Circuit is “liberal”, which I interpret to mean capable of looking at each case on its own merits rather than round file’ing everything under “precedent” (someone else had a case sorta like this one, so let’s not bother with putting out any effort to see that justice is rendered - aka precedent)

    Came in handy when the 9th Circuit remanded my case back to the Billings Federal District Court, after the senior judge decided a pro se plaintiff was a bit of a bother.

    And I’ve put another (class action) case in front of the 9th Circuit, just to see how they respond to the Interior Dept’s avowed self-right to practice discrimination…labeled diversity, this diversity achieved by practiceing gender and race preferences in hiring and promotion. The best qualified candidate, ksa’s, does not have to be selected.

    It’s a matter of choice, a little “color” in the room, or someone in public service that can do the job…and the choice is ours,whether to allow discrimination or to demand equality for all.
